Our client is a U. S. company which custom designs, manufactures and installs advanced thermal systems which operate at temperatures up to 3000º Celsius. They have a small office in Germany to service their European customers. One of their employees had previously been in the United States as an H-1B specialty worker, but was subject to the H-1B cap because he had been out of the United States for more than one year.
Consequently, we had the company petition for him as an L-1B specialized knowledge employee. The petition was approved by U. S. Citizenship and Immigration Services on the basis that the company was engaged in regular and systematic business engagements at its branch office notwithstanding the fact that it was staffed by contract employees.
