Voluntary departure granted to PRC citizensPublished: Jun 27, 2008 By: Robert D. Kolken Source: My Source
Our two clients are citizens of the People’s Republic of China. They were in the United States as business visitors monitoring the dismantling of a large hydraulic die press, which their Chinese employer had purchased. Because the project took longer than expected, they overstayed their status.
A trial was held before an Immigration Judge to determine whether they should receive discretionary relief from removal. Concern was raised over whether the press could be used for the manufacture of equipment which would be detrimental to the interest of the United States. After hearing all of the evidence we presented, the Immigration Judge granted Voluntary Departure as requested, which means that our clients will not be subject to an Order of Removal.
