We successfully represented a client in her application for adjustment of status to lawful permanent resident before the Immigration Court. The client’s application, based on her marriage to a
United States citizen, had been previously denied by the Immigration Courtin its exercise of discretion. However, a remand was secured from the Board of Immigration Appeals to reconsider her case in light of her husband’s health problems.
On further review, the Court agreed that the client’s U.S. citizen husband and daughter would suffer hardship beyond the “normal” hardship that occurs in a deportation case, and granted the client permanent resident status to remain lawfully in the U.S. with her family.
