We just won an appeal overturning the denial of asylum before the Immigration Court in Buffalo, New York. Our client, a citizen of Guyana, had his asylum application denied, and he was ordered deported on November 24, 2006 by an immigration judge with a 92.4% denial rate. We appealed the denial, arguing that the Court made a material error of law by ruling that our client was not eligible to apply for asylum in the first instance.
The Board of Immigration Appeals agreed with our arguments that the asylum denial was improper and remanded the case back to the Immigration Judge for a new hearing.
