Our client is a citizen of Jamaica. He married a United States citizen after Immigration Court proceedings were instituted against him. We prepared and filed a Petition for Alien Relative submitted by his United States citizen spouse on his behalf, along with a Request for Bona Fide Marriage Exemption to permit approval of the Petition without subjecting him to a two year foreign residence requirement. We submitted documentary evidence to prove the bona fides of the marriage. We prepared the clients for the Marriage Fraud Interview, which is held under oath, and accompanied them to the interview. The wife’s Petition was approved after an examination held in our presence which lasted less than 30 minutes.
Previously, we had the Immigration Court proceedings administratively closed for the purpose of adjudication of the wife’s Petition. We will now move to recalendar the proceedings so that our client may apply for adjustment of status to a lawful permanent resident. When Immigration Court proceedings are instituted, the Department of Homeland Security does not have jurisdiction over the permanent resident application.
