BIA Remands Case Back to Immigration Judge

Matthew L. Kolken, Esq. successfully argued that an Immigration Judge erred in denying his client’s application for asylum.  Mr. Kolken’s clients arrived in the United States from Albania, leaving their home country to escape persecution, which took the form of the kidnapping of their child who was taken from the family home at gun point on Christmas day, as a form of political intimidation, and punishment.

The Board of Immigration Appeals ruled that the Immigration Judge failed to properly acknowledge the corroborating documentation that was submitted in support the application for asylum, which if authentic support the claim for asylum, and remanded the case back to the Judge so that he could properly address these documents which definitively establish the family’s case.
