Immigration Court Proceedings Dismissed

Robert D. Kolken, Esq., obtained dismissal of
Immigration Court
proceedings brought against a citizen of Jamaica who has been a lawful permanent resident of the States for approximately 24 years.  Unfortunately, the client was deportable for having been convicted of a sexual related misdemeanor in 1984 because of the retroactive application of the aggravated felony provisions.  We had his United States citizen wife file a new Petition for Alien Relative on his behalf, which was approved by the Department of Homeland Security because his marriage was bona fide.  The client is now eligible to apply for a new green card because he is not inadmissible to the United States due to the petty offense exception, notwithstanding his aggravated felony conviction.
