Deportation order Vacated

A deportation order that was issued against our client in over a decade ago has been vacated by the Immigration Judge by the filing of a motion to reopen proceedings.  Our client was born in Yugoslavia ( Montenegro ), and was originallyplaced in exclusionary proceedings on December 5, 1992.

Matthew L. Kolken successfully argued that the ineffective assistance of previous counsel caused the our client's previous administrative hearing to be tainted so as to render the proceedings fundamentally unfair in violation of his Constituionally protected right to due process.  Changed country conditions in the Respondent’s native Montenegro were also cited in support of the motion to reopen.  Our client was in custody when he retained us.  We were able to secure his release from custody while we have been fighting to keep him in the country.
