Hard Fought Green Card Victory

Published: May 10, 2007 By: Matthew L. Kolken Source: My Source

We just obtained a Green Card for our client, a citizen of Canada, after a three year wait.  Our client is married to a United States citizen, but had previously overstayed her status, and subsequently departed the United States. As a result she was stuck outside of the country. We first had to convince that United States Consulate that our client was not inadmissible to the United States when applying for her visa to return.  We won this battle and a visa was issued.

Our client then entered the United States, but immediately departed to settle her affairs in Canada.  While in Canada she lost her passport which contained her visa, and then returned to the United States without it.  She was admitted to the United States without the visa, but had no proof of her last entry which was required by the government in order for her to be able to apply for her Green Card inside of the country.

The USCIS has finally approved her Green Card application.  In three more years she will be eligible to apply for United States citizenship.
