Deportation Order Vacated by the Board of Immigration Appeals

The Board of Immigration Appeals reopened a final order of removal on behalf of our client who is a citizen of Iraq, acting upon a motion filed by Robert D. Kolken, Esq.  The basis for the motion was that one of our client’s convictions was vacated by the criminal court because his guilty plea was not voluntary, knowing, and intelligent. 

The Board of Immigration Appeals agreed with us that the conviction was vacated on the basis of a procedural and substantive defect.  The case was remanded to the Immigration Judge for further proceedings.
